The Regular Meeting of City Council was held in the Council Chamber, City Hall, 200 Craig Street, Duncan, BC at 7:30 p.m., June 25, 2001.

 

 

Present:      Mayor Michael Coleman, Councillors Mike Caljouw, Sharon Jackson, Phil Kent, Martin Lukaitis, Geoff Maxwell and Ken Newcomb.

 

Also Present: Paul Douville, City Administrator.

 

 

His Worship Mayor Michael Coleman opened the Council Meeting with a prayer and called for order.

 

Adoption of Minutes

       THAT the Minutes of the Regular Meeting of City Council held on June 11, 2001 be adopted.

Delegations

 

Stephanie Cleough - Junior Mayor

Representing the City of Duncan Junior Council, Junior Mayor Stephanie Cleough presented a Certificate of Recognition to Mayor Coleman. The certificate reads as follows:

 

“The Mayor & Council of the City of Duncan is hereby recognized by the Junior Council of the City of Duncan for its ongoing commitment to youth, and particular for educational opportunities provided through the Junior Council program.”

 

The certificate was signed by all seven members of the Junior Council.

 

Mayor Coleman thanked the Junior Council for a job well done and the Junior Council representatives left the meeting.

Salvation Army - Business License Fee

      THAT the Council of the City of Duncan regretfully deny the May 29, 2001 request from the Salvation Army (Cowichan Valley Ministries) for waiver of the business license fee noting there is no bylaw provision to waive business license fees and noting there are other not-for-profit organizations and businesses that are in the thrift store business in our community.

Duncan Dawgs - Beer Garden

       THAT the Duncan Dawgs Football Club be authorized to host a Beer Garden at McAdam Park in conjunction with the 16th Annual Can-Am International Men’s Flag Football Tournament between 12:00 noon and 8:00 p.m. on September 1st (Saturday), September 2nd (Sunday) and September 3rd (Monday – Labour Day), 2001 as requested in their June 6th, 2001 letter subject to payment of $100.00 per day in addition to rental rates and subject to compliance with the Beer Gardens’ Policy;

 

     AND THAT in light of the complaints received about music volume levels during previous Tournaments, the event organizers (i.e. Martin Mould) be requested to insure us in writing by July 27th, 2001 of compliance with the following items:

 

 

1.              Music volume must be kept at a reasonable level.

2.              Music volume will be reduced if a request is received from residents in the vicinity of McAdam Park or City Officials.

3.              The music system speakers must face towards the Cowichan River;

 

      AND THAT there be a $300.00 deposit, which will be returned to the Duncan Dawgs Football Club if the park and facilities are left in a clean and undamaged condition.

New Ministry of Community, Aboriginal and Women’s Services

      THAT the letter received June 14, 2001 from new Minister George Abbott of the new Ministry of Community, Aboriginal and Women’s Services, regarding building strong communities and local governments, be received, the contents noted and filed.

Conventional and Custom Transit

For consideration was a letter dated June 13, 2001 from the Mayor of the Township of Esquimalt on behalf of the Board of Directors of BC Transit.

     THAT the Council of the City of Duncan reaffirm support of conventional and custom transit throughout the Province of British Columbia;

 

     AND THAT Council support the transit partnership in BC (i.e. Provincial Government and Local Governments with the prospect of Federal Government Funding) and endorses the following three goals for senior government support:

 

  • Continued provincial support for public transportation to keep pace with growth;

 

  • Federal tax exemption for employer provided transit benefits; and

 

  • Redirection of the equivalent of 3 cents a litre of existing federal fuel excise tax to public transportation nationally;

 

 

      AND THAT Council forward this resolution to our MLA, the Honourable Graham Bruce, requesting his support in this regard. (Reference June 13, 2001 letter from the Mayor of Esquimalt).

Health Care System Problems

      THAT the Council of the City of Duncan encourages that all sides in the current health care crisis challenge their best and brightest negotiators to find compromise in the issues facing the local health region and to present a unified case to the senior government on those issues of provincial jurisdiction.

Chlorine vs. Ozone, Hydrogen Peroxide and Silver Ions

      THAT the June 13, 2001 letter from Duncan Crow, regarding the alleged ill effects of chlorine and the preferred use of ozone, hydrogen peroxide and silver ions, be referred to Dr. Fred Rockwell, Medical Health Officer – Central Vancouver Island Health Region, for comment back to City Council.

Church Picnic – July 2, 2001 - Centennial Park

      THAT as requested in the June 17, 2001 letter from Margie vanBoven of the Duncan Reformed Church, Council authorize the staging of a Church Picnic in Centennial Park from 11:00 a.m. to 4:00 p.m. on July 1, 2001 and to use the washrooms building subject to the following terms and conditions:

 

 

  1. Music and P.A. System volume must be kept at a reasonable level.

 

  1. Volume will be reduced if a request is received from a resident in the vicinity of Centennial Park or City Officials.

 

  1. Payment of a $300.00 damage deposit, which will be returned if the Park and facilities are left in an undamaged and clean condition.

 

  1. Since parking is very limited at Centennial Park, a shuttle service to and from the Park be provided.

 

  1. The organizers of the event hold harmless the City of Duncan from any and all possible liability claims related to the event.

 

  1. The organizers arrange for a minimum public liability insurance coverage of $1,000,000. for the event with the City of Duncan being named an “Additional Insured” party and that a copy of the policy be provided to the City Administrator.

City Square

Councillor Maxwell advised that he has more than 50 responses regarding the proposed City Square concepts. He said that these responses will be reviewed by the Parks & Recreation Committee and a recommendation will be formulated for City Council.

 

 

 Planning Committee

170 Trans Canada Highway – CARE Funeral Services

      THAT the March 29, 2001 application to rezone 170 Trans Canada Highway from C-3 (Service Commercial) to C-1 (General Commercial) to accommodate a Funeral Home and Services business be denied for the reasons outlined in the June 12, 2001 report from the Building Inspector;

      AND THAT the suggestion for a text amendment to the C-3 (Service Commercial) zone to add this use to the existing zone also not proceed.

Carried.

 

 

Councillor Jackson advised that for spot zoning, traffic flow and parking issues, the Planning Committee could not provide positive consideration for this application. However, she said that this was the type of business that would be welcomed in our community and has asked the Economic Development Officer and a Realtor to assist the applicants to locate in Duncan.

 

Dhut Development – 229 Evans and 437 Jubilee Street

      THAT the proposed three-story six-unit apartment building and development variance permit application for 229 Evans and 437 Jubilee (Dhut) be referred to the Advisory Planning Commission for input and recommendation.

 Public Safety Committee

 

RCMP Strategic Planning

Councillor Newcomb reported on the June 19, 2001 Public Safety Committee meeting. He said that all Councillors were present to meet with Inspector Linton Robinson and Corporal Brian Brown.

 

The RCMP Officers outlined their Strategic Planning process, noting that the major issues identified are:

 

·        Traffic

·        Organized Crime (Drugs)

·        Youth.

 

The issues of spousal assaults, wet/dry grads and B & E’s were also discussed in detail at this meeting.

 

 

 Fire Committee

 

Retirements

Councillor Caljouw reported on the June 13, 2001 celebration at the Duncan Fire Hall to honour retiring firefighter Scott Sheets (10 years of service) and retiring firefighter Jim Ingham (15 years of service).

 

 

On behalf of the community, the Mayor and Councillor Caljouw thanked these firefighters for their dedicated service.

 

 

 Reports of Special Committees

 

Wine Festival

Councillor Maxwell reported that he recently met with the Vintners Association to plan further for the September 7, 8 & 9 Wine Festival. Via Rail will be providing a wine train for these dates and are planning on adding an additional car. There will be Grape Stomping, an Iron Chef Cook-Off, a Wine Garden, Winery Tours and a Gala Ball.

 

Arts & Sports Scholarships

On behalf of the Cowichan Community Centre Commission, Councillor Kent advised that he was pleased to present the following scholarships at Cowichan Secondary:

 

Erin Bower – Sports

Amanda Whiteing – Sports

Nicole Nelson – Arts.

 

VI Library Board

Councillor Kent reported that on June 22, the Library Board considered Labour Relations issues. The CUPE contract expires June 30, 2001 and negotiations should commence in the early fall. The BCGEU contract is also terminating at the end of this year.

 

 

On June 23, the Board dealt with many issues including the following:

 

 

  • They intend to institute a system-wide Internet proxy server to avoid the problem of unwanted surfing.

 

  • The grant from Microsoft will be used to accumulate a CD collection for borrowers.

 

  • The preliminary 2001 budget was distributed and has been given to the City Treasurer for early attention.
  • As a fundraising activity, a percentage of the education fees will be appropriated back to the Library system.
  • The Sooke Branch is now officially part of the system.

 

Miscellaneous

Councillor Caljouw reported that as Deputy Mayor he recently met with the new MLA, the Honourable Graham Bruce, MP Reed Elley, the Chair of the CVRD Board and the Mayors of Ladysmith, Lake Cowichan and North Cowichan regarding economic development. He said the meeting was most productive and he will be reporting further in this regard.

 

Councillor Caljouw further advised that he and the Administrator met with the Cowichan Tribes Land Manager, Fran Wilgress, on June 25 regarding the proposed Wal-Mart development. He said he would report further to Council “In Committee”.

 

 

Councillor Jackson reported on the Race Relations Advisory Committee. She said they are instituting a positive method to reduce racial tension entitled “Sustained Dialogue”. This face-to-face methodology has been very successful in many communities. They are also undertaking a community-mapping project to identify perceived positive and negative issues in the community.

 

 

On June 23, she and the Administrator attended the retirement party of Jack Hutton at Providence Farm.

 

 

On June 24, she attended the Duncan United Church and participated in the appreciation activities on the departure of Reverend Jim Short. He has been reassigned to a Ladner United Church.

 

 

Mayor Coleman reported on the following items in which he participated:

 

 

  • Retirement celebration for Scott Sheets and Jim Ingham on June 13.

 

  • The Garriock Invitational Track & Field Meet at Chesterfield Sports Complex on June 16 (meet records were set).

 

  • DBIAS/City Fathers’ Day ballgame on June 17 at the Moose Lodge.

 

  • Malaspina Student Awards on June 20.

 

  • The 20th anniversary of the Cowichan Valley Intercultural & Immigrant Aid Society on June 22.

 

  • The 65th anniversary of the local Kinsmen Club on June 23.
  • The Chemainus Parade is being staged on June 30.
  • Canada Day celebrations will be held on July 1 at the Chesterfield Sports Complex.

 

 

Unfinished Business

 

Fire Truck Loan Authorization Bylaw No. 1917, 2001

      THAT Council ratify July 24, 2001 as the deadline for completion of the counter petition period relating to the purchase of the proposed new Fire Pumper Truck (note: public notices were advertised in the newspaper on June 20 and 24, 2001);

      AND THAT a Special Council Meeting be scheduled for 4:30 p.m., July 24, 2001 to consider Final Adoption of the “Fire Truck Loan Authorization Bylaw No. 1917, 2001” subject to the results of the counter petition.

Councillor Caljouw reported that the purchase of this new fire truck is a necessity due to the classification of equipment by the Insurance Underwriters Association. Once fire trucks are 20 years old, they can no longer qualify as “first responders” and therefore insurance rates increase in the community if new equipment is not purchased.

 

 

He encouraged the community to support this purchase.

 

Cowichan Tribes Mound Land

Downtown Neighbourhood Revitalization Committee – Grant Application

      THAT the Council of the City of Duncan support the application for a Community Planning and Development Grant for the Downtown Neighbourhood Revitalization Committee’s proposed concept for revitalizing the historical downtown, including phases one and two for a total budget of $37,775 (including in kind contributions) and a grant of $5,000.

New Business

 

Community Charter

Councillor Kent referenced Private Members Bill 222 introduced by then Leader of the BC Liberal Official Opposition Gordon Campbell. He requested that the Executive Summary of this Bill again be distributed to Council for review since the Liberals have now formed the government and the Community Charter will likely be a subject of much debate very soon.

 

Nora Maxwell – 80th Birthday

Councillor Maxwell advised that he recently participated in the 80th birthday celebration for Nora Maxwell (no relation).

 

Special Meeting
