The Regular Meeting of City Council was held in the Council Chambers, City Hall, 200 Craig Street, Duncan, BC at 7:30 p.m., March 26, 2001.

His Worship Mayor Michael Coleman opened the Council Meeting with a prayer and called for order.

Adoption of Minutes

THAT the Minutes of the Heritage Designation Public Hearing and the Regular Meeting of City Council held on March 12, 2001 be adopted.

April 28, 2001 By-Election - Ballot Order

With the aid of one of the Shaw Cable camera operators, the Chief Election Officer, Paul Douville, had the names of the candidates for the April 28, 2001 By-Election drawn out of a box to determine the order on the ballot in accordance with the Procedures Bylaw. The order determined by the draw was as follows:

Tethered Dogs

For consideration was a letter received February 26, 2001 from Penny Simpson of the Cowichan Cat Rescue and letters dated February 26 and March 8, 2001 to and from the Cowichan & District Branch of the SPCA.

WHEREAS City Officials have never received a complaint regarding dogs being inhumanely tethered in the City of Duncan;

AND WHEREAS there are very good provisions in the Prevention of Cruelty Act and the Criminal Code to enable the SPCA to satisfy their concerns on issues such as lack of sustenance and adequate shelter, the medical condition of dogs and the enforcement of medical intervention if required;

THEREFORE BE IT RESOLVED THAT the Dog Regulation Licencing and Impounding Bylaw, 1980, No. 1290 not be amended to include a "humane tethering provision" as requested in the February 26, 2001 letter from Penny Simpson of the Cowichan Cat Rescue.

Amyotrophic Lateral Sclerosis Society - Tag Day

THAT the Council of the City of Duncan authorize the North-Central Island Chapter of the Amyotrophic Lateral Sclerosis Society of BC (ALS or Lou Gehrig's Disease) to conduct their annual Flower Day fundraising venture in the City of Duncan on June 2, 2001 as requested in their March 12, 2001 letter.

Shaw TV Planned Food Drive

For consideration was a letter dated March 15, 2001 from Shaw Cable.

THAT Shaw Cablesystems be authorized to conduct a tag day on May 12, 2001 (Saturday) in the City of Duncan by soliciting residences for food stuffs for the 3 local area food banks.

Reports of Standing Committees

 

Planning Committee

   

March 20, 2001 Meeting

Councillor Jackson reported that the Planning Committee had an excellent meeting with representatives of the Duncan Business Improvement Area Society (DBIAS), the Downtown Neighbourhood Revitalization Committee (DNRC) and the Advisory Planning Commission (APC) on March 20, 2001. She said the meeting concentrated on rejuvenation of the downtown core and said that this will not be the last of these types of meetings.

Mayor Coleman announced that Council is attempting to produce no or a low tax increase for 2001. In order to do so, balancing new capital works in this scenario will be a delicate issue.

Policy on Racism

For consideration were the notes of the March 22, 2001 meeting of the Race Relations Committee.

THAT as recommended by the Race Relations Committee, the following Policy on Racism be adopted:

"City of Duncan Policy on Racism

The City of Duncan is dedicated to the elimination of racism. The City intends to lead by example and will take action against racism by actively:

    • Promoting institutional policies and practices that eliminate racism
    • Promoting harmonious relationships among the diverse populations of the Cowichan Valley
    • Promoting diversity in the leadership of key community institutions
    • Promoting "zero tolerance" of overt acts of racial discrimination."

Miscellaneous

Councillor Kent reported on the following items:

  • He attended the March 24, 2001 Vancouver Island Regional Library Board meeting. He noted that Mayor Jack Peake of Lake Cowichan functioned as a good Chair of the Board meeting.
  • At this Board meeting, the new Internet Access Policy was adopted following consideration of input provided by a delegation of parents of school aged children. The policy contains acceptable use clauses, which stipulate that there is to be no access to sites containing obscenity or pornography. He said the policy issues will be well signed in the various branches and an education process is underway. Users must agree with the policy before logging onto the World Wide Web.
  • The Library Board noted that the Capital Reserve Investment is low since the fund has been utilized for major capital projects over the last few years. The low level should be rectified this year and subsequent years noting that the year 2000 surplus was $178,000.
  • Central Saanich has now withdrawn from the Library system but the Municipality of Sooke has decided to become a member.
  • The Library Board agreed to join the BC Library Trustees Association to further the goals and objectives of our local system.
  • On March 22, 2001, Councillor Kent attended the Cowichan Community Centre Commission meeting which concentrated primarily on regional funding for the Theatre. The proposed funding formula is now being processed by the CVRD Board of Directors.
 

Councillor Maxwell reported that he attended a recent meeting with the BC Ferry Corporation regarding the promised endeavours to continue the operation of the Mill Bay/Brentwood Ferry. An official relaunch will take place in May and much better signage will be provided along the Trans Canada Highway to encourage more users of this ferry. The Ferry Corporation projects that with only a 1/2 more vehicle per sailing, this ferry route should be placed into a "break-even" financial position.

 

Councillor Jackson reported that on March 14, 2001 she represented the City at the Cowichan Music Festival Gala Event. She said she was happy to present the City award to Kaivon Paksad-Vaezi for piano.

Councillor Jackson reported further that she participated in the Kin Park "Call to Action" celebrations on March 20, 2001. She said murals have been installed on the perimeter fence at Kin Park and safety issues were highlighted during the event. Making Kin Park safe for all ages is the goal of this caring and beautification project.

 

Mayor Coleman reported that a Joint Council Meeting with the Council of the District of North Cowichan occurred on March 19, 2001. The purpose of this meeting was to discuss the eventual siting of the new proposed library. A Sub-Committee has been formed to consider all aspects and report back to both Councils within 30 days. The Sub-Committee Members are Mayor Rex Hollett, Councillor Glen Ridgway and Councillor Phil Kent.

 

Unfinished Business

Green Door Society

THAT all items on the March 26, 2001 Council Agenda regarding the Green Door Society, including the "Green Door Society Heritage Structure and Site Bylaw No. 1913, 2001" be TABLED until after the proposed negotiation meeting with the Society.

This negotiation meeting is scheduled for 7:00 p.m., April 10, 2001 at City Hall.

Minor Hockey Program Advertisement

THAT Council agree to share with the District of North Cowichan in a half-page advertisement in the "Best Ever Source for Sports Cup Tournament" program as requested in the letter received February 23, 2001 from the BC Amateur Hockey Association and the Cowichan Minor Hockey Association (i.e. $110.00 x 1.07 GST = $117.70 ÷ 2 = $58.85).

Note: The CVRD has declined on participating since the Lake Cowichan Area and the north part of North Oyster are excluded from the BC Amateur Hockey Association.

THAT Council agree to install, maintain and pay for a sign 60cms (24") x 91cms (36") with 5cms (2") lettering for Government Street at Boundary Road (sign cost: $147.00) as requested in the March 20, 2001 letter from the District of North Cowichan Municipal Engineer following-up on the Well Protection Plan.
