The Regular Meeting of City Council was held in the Council Chamber, City Hall, 200 Craig Street, Duncan, BC at 7:30 p.m., October 9, 2001.

 

 

Present:      Mayor Michael Coleman, Councillors Mike Caljouw, Sharon Jackson, Phil Kent, Martin Lukaitis, Geoff Maxwell and Ken Newcomb.

 

Also Present: Paul Douville, City Administrator.

 

 

His Worship Mayor Michael Coleman opened the Council Meeting with a prayer and called for order.

 

Adoption of Minutes

RCMP S/Sgt. Howard Goodridge

RCMP S/Sgt Howard Goodridge addressed Council on the activities of the North Cowichan/Duncan Detachment.

 

He outlined the following information:

 

1. CRIME STATISTICS FOR THE CITY OF DUNCAN

 

 

Overall, crime has remained relatively similar to the previous year (2000) except for the area of theft of motor vehicles (3 in 2000 vs. 6 in 2001) and driving offences, in particular:

 

 

·       Hit & Runs (1 in 2000 vs. 6 in 2001)

·       Drive while prohibited (0 in 2000 vs. 4 in 2001)

·       Drive over .08 (2 in 2000 vs. 10 in 2001)

 

 

2.   QUARTERLY CRIME REPORT

 

 

In the 4th quarter 2000, the change in Criminal Code offenses reported has decreased.

 

·        3rd Quarter 2000 -13%

·        4th Quarter 1999 11%

 

For 1st Quarter of 2001, we have remained the same overall:

 

·               4th Quarter 2000    0%

·               1st Quarter 2001  -11% (decrease)

 

 

 

Of particular note, these statistics are for Duncan Provincially, not just the City of Duncan. However, there is a substantial difference between Crime Rate (criminal offenses reported per 1,000 population) for the Municipality, 85; Provincially, 177 and City of Duncan, 261.

 

 

3.  PROVINCIAL MEMBERS WORKING WITHIN THE MUNICIPALITY VS. PROVINCIAL AREAS

 

Inspector Linton Robinson was requested to review their statistics to verify that their District of North Cowichan members are working within the "boundaries" of the District of North Cowichan and not more so within provincial boundaries.

 

They presently have 27 members on Municipal strength and 24 members on Provincial strength, or 53% Municipal and 47% Provincial.

 

A review of the calls for service indicates/verifies the following:

 

2000: 54% calls for service – Municipal

46% calls – Provincial

 

2001 (January to June):

51% Municipal

49% Provincial

 

 

4.  COUNTER ATTACK PROGRAM:

 

 

Surveys conducted within the Province of BC indicate that 1 in every 25 vehicles between 10:00 p.m. and 3 a.m. contained an impaired driver. This 4% accounts for 38% of fatal accidents.

 

The local CounterAttack Program has surpassed (statistically) all other programs within the Province for Driving Over .08 charges.

 

A breakdown of the areas/jurisdictions of where the stop checks/arrests have taken place are as follows:

 

At the time of this report, 70 impaired charges have been laid compared to 68 in 2000:

City of Duncan 13

CVRD           23.

 

 

 

5.   AUXILIARY PROGRAM

 

 

Due to the change of directive/policy by the Attorney General of BC, the Municipality of North Cowichan contributed $10,000.00 towards this

 

program this past year. Five additional auxiliaries are presently being trained at this time, giving this detachment a total of nine auxiliaries.

 

 

6.   COMMUNITY POLICING/CRIME PREVENTION

 

 

S/Sgt. Goodridge referenced the reports of Constables Brian Brown, Mike Field and Ellen West in this regard.

 

 

7.   VICTIM SERVICES REPORT/STATISTICS:

 

 

S/Sgt. Goodridge referenced the monthly statistical summaries for the police-based victim assistance program. He noted that use of the program is escalating dramatically with positive results.

 

 

8.   HUMAN RESOURCES:

 

 

At the present time, the detachment is "up to strength" or at full complement. S/Sgt. Goodridge then outlined a number of transfers that have occurred since the last report.

 

 

A number of questions were then posed to S/Sgt. Goodridge, he was thanked for his presentation and he left the meeting.

Referencing information from the World Wide Web on the fund established by the New York City United Way entitled "The September 11

 

Fund", it was noted that to date

$300,000,000 (U.S.) has been raised and approximately $6,000,000 (U.S.) has been utilized. It was suggested that members of the community may wish to donate to this fund individually or through our local United Way.

      WHEREAS the proposed Sound Baffle Capital Project for the Aquannis Centre and Arena is not in the Financial Plan;

     AND WHEREAS completion of this project is not an order from the Workers' Compensation Board;

      THEREFORE BE IT RESOLVED THAT the proposed Sound Baffle Capital Project for the Aquannis Center and Arena be added to the Financial Plan for 2002 for consideration as a budget item and be processed through the regular budget process.

Prior to this vote occurring, Councillor Kent, Chair of the Cowichan Community Centre Commission, noted that the relatively low tender amount was possible since the contractor is working nearby in Nanaimo. He suggested that if the project is re-tendered in 2002, the cost would likely be higher.

 

Animal Spaying

      WHEREAS the Coquitlam and Surrey Bylaws apply only to cats;

 

 

     AND WHEREAS Section 703 of the Local Government Act reads in part as follows and does not specifically reference authority to require the spaying or neutering of cats and dogs:

 

 

     "Keeping of animals

703. (1) A council may, by bylaw, do one or more of the following:

(a) regulate or prohibit the keeping of dogs, horses, cattle, sheep, goats, swine, rabbits or other animals and define areas in which they may be kept or may not be kept."

 

            AND WHEREAS enforcement of such a Bylaw would be extremely difficult;

 

 

     AND WHEREAS this concern expressed by Ms. Kivari is the sole one received at City Hall;

 

      THEREFORE BE IT RESOLVED THAT the October 2, 2001 letter from Kristin Kivari, regarding the mandatory spaying and neutering of cats and dogs, be received, the contents noted and filed.

  • The DBIAS holding harmless the City of Duncan from any and all possible public liability claims.
  • Provision of liability insurance to a minimum of $2,000,000 per occurrence for this event.

·        Payment of a $300.00 deposit, which will be returned to the DBIAS if the Park and infrastructure are left in a clean and undamaged condition.

 Public Safety Committee

 

 

Councillor Newcomb reported on the following items:

 

·        At the recent UBCM Convention, the group of 14 municipalities facing the commencement of policing costs met. The first meeting was to establish a strategy for meeting with the Premier and the Solicitor General. At the meeting with the Premier and the Solicitor General, the group of 14 stated their position that all residents of British Columbia should pay their fair share for policing and that a more equitable phase-in for those currently not paying should be instituted. He advised that he will provide a recommendation to City Council in the near future.

 

 

·        Also at the UBCM Convention, he completed a safety issues questionnaire at the ICBC booth. A draw of the completed questionnaires was then made and Councillor Newcomb won a free road safety audit for the City of Duncan.

 

 

·        On October 5, he attended the Call To Action – Women's Safety Audit meeting regarding the James Street, Alderlea Street and Kin Park areas. He said the final draft of the report is being distributed for comment and recommendations will be forthcoming to City Council.

-                Urban Communities Forum dealing with policing and the RCMP accountability

-                The softwood lumber dispute

 

 

·         On October 2, he attended the Chamber of Commerce Board of Directors meeting in preparation for Small Business Week October 21 – 27, 2001:

 

 

-              There was a presentation from Bea Woywitka of the Duncan Executive Club wherein she turned over $3,000 worth of bursary funds to the Chamber for distribution to worthy students.

 

 

-                The Chamber has established a new networking forum entitled "Business Exchange" where new businesses show their wares and services. The next exchange is scheduled for 5:30 p.m. to 8:30 p.m. on October 16th at the Silver Bridge Inn.

 

 

Councillor Maxwell reported on the recent Tourism Association of Vancouver Island Board of Directors meeting. He said that the Tourism Association of Campbell River has managed to attract 30 – 40 Japanese travel agents to their area. It is hoped that some of these agents can be attracted to the Cowichan Valley. TAVI is also attempting to get some of the 780 German travel agents visiting the lower mainland to visit Vancouver Island. These German travel agents represent over 80,000 travelers.

 

 

Councillor Caljouw reported that he represented City Council at the 20th anniversary celebrations of Cowichan Lodge and at the recent opening of the new Burger King.

 

 

Councillor Lukaitis reported that all members of the UBCM were represented at the recent UBCM convention. He said the Municipal Market Place was very informative and referenced the 27 clinics provided, the address from the Honourable David Anderson and the appointment of Hans Cunningham as the new UBCM President.

 

 

Mayor Coleman referenced the October 1st Cowichan Valley Arts Council Reverse and Revision Event, the October 3 Tour de Rock RCMP Cancer fundraising project and the October 6 Breastfeeding Event at the Cowichan Community Centre (Guinness Book of Records event).

Canada/Ingram/Queens Intersection Traffic Study

For consideration was a letter and memo dated July 11 and 17, 2001 from the City Engineers, Stantec Consulting Ltd. and from the Public Works Superintendent.

Federal Government Policy on Affordable Housing

      THAT the Council of the City of Duncan encourage the Honourable George Abbott, Minister of Community, Aboriginal and Women’s Services, and our local MLA, the Honourable Graham Bruce, to support a program for low income households, to devote significant new funds to the program and to involve local governments in designing and implementing the program locally.

AVICC and UBCM Notice of Motion

For consideration was a memo dated October 4, 2001 from Councillor Kent.

      WHEREAS it has been the policy of the City to allow any member of Council, without restriction, to attend both the UBCM and AVICC annual conferences;

 

 

     AND WHEREAS a need for additional fiscal prudence, during an uncertain economic climate is essential;

     THEREFORE BE IT RESOLVED THAT the policy of the City, herewith, limit the attendance to four(4) delegates to include the Mayor and three(3) others (inclusive of administrative staff) to the UBCM and AVICC annual conferences;

     AND THAT the delegates be chosen to attend on a rotational basis. Therefore each Councillor will attend at least one(1) of each of the UBCM and AVICC conferences in their three year term;

      AND THAT if one(1) or more of the Councillors cannot attend in their turn, that delegates be chosen by way of a draw to attend in their place.

 

The Administrator was asked to bring this resolution forward to the October 29, 2001 Council meeting.

      AND THAT this work be undertaken in conjunction with the construction aspects of the City Square project.
