A Development Variance Permit Hearing was held in the Council Chambers, City Hall, 200 Craig Street, Duncan, BC at 7:30 p.m., April 28, 2003.

 

Present:     Mayor Michael Coleman;

             Councillors Mike Caljouw, Jenny Farkas, Phil Kent, Geoff Maxwell and Ken Newcomb.

Absent With

Prior Notice: Councillor Sharon Jackson.

 

Also Present: Paul Douville, City Administrator.

 

 

His Worship Mayor Coleman called the meeting to order and advised that the purpose of this Public Hearing was for Members of Council to hear all input regarding the proposed Development Variance Permit and consider all facts presented.  He further advised that decisions are not reached at Public Hearings, but in Regular Meetings of City Council.  He asked the City Administrator whether all required notifications were duly fulfilled for the subject matter before this Public Hearing and was advised that the requirements were fully met.

 

271 Campbell Road – Development Variance Permit

The purpose of this Public Hearing was to consider a proposed bare land strata title subdivision for 271 Campbell Road (Legal description: Lot 4, Section 16, Range 7, Plan 8125, Quamichan District, PID 000-380-849) and a related Development Variance Permit for the following items:

 

 

  1. The existing dwelling to abut the common property area
  2. The minimum side-yard setback to be 0.0 metres rather than the required 1.5 metres (5')
  3. The south side eave of the existing dwelling to encroach into the Common Property.

 

 

 

There was no correspondence received in response to the April 10, 2003 circular sent to affected property owners and tenants within 60 metres of 271 Campbell Road.

 

 

Mr. Graham Edwards of 950 Marchmont Road addressed the Hearing and advised that he was in favour of the proposed strata subdivision and Development Variance Permit, however, he asked why City Council had refused a subdivision of this property in the past. It was explained that a previous application was for a pan-handle lot subdivision which creates a long driveway beside a dwelling that has no control over the condition of the property on which the driveway exists. The new proposal is for a bare land strata subdivision, which provides for the driveway to be common property and owned by the owners of both strata lots.

 

 

Mrs. Beverly Edwards of 950 Marchmont Road also addressed the Hearing and asked for clarification of the location of the proposed dwelling. She was referred to the dotted line on proposed Strata Lot B.

 

 

Mayor Coleman called for further public input 3 times and hearing none, declared the hearing adjourned at 7:40 p.m.
