A Public Zoning Hearing was held in the Council Chambers, City Hall, 200 Craig Street, Duncan, BC at 7:30 p.m., January 13, 2003.

 

Present: Mayor Michael Coleman;

         Councillors Mike Caljouw, Jenny Farkas, Sharon Jackson, Phil Kent, Geoff Maxwell and Ken Newcomb.

Also

Present: Paul Douville, City Administrator.

 

 

His Worship Mayor Coleman called the meeting to order and advised that the purpose of a Public Hearing was for Members of Council to hear all input regarding a proposed Rezoning Bylaw amendment and consider all facts presented. He further advised that decisions are not reached at Public Hearings, but in Regular Meetings of City Council. He asked the City Administrator whether all legal advertising was duly fulfilled for the subject matter before this Public Hearing and was advised that the requirements of the BC Local Government Act were fully met.

 

Tent Structures & Height Definitions

For consideration were the following items:

 

Zoning Bylaw No. 1540, 1988, Amendment Bylaw No. 2, No. 1946, 2003:

 

1.   By adding the following to PART FIVE – GENERAL REGULATIONS, Part 5.10:

 

"(f) notwithstanding the provisions of clause 4.4.(a) of this bylaw, tent structures shall be permitted as accessory structures in commercial zones as temporary seasonal storage buildings and for special events, provided they comply with all other aspects of this bylaw. Tents shall not be used for assembly occupancies, except for special events as authorized by Council.

(g)  Tent structures shall require temporary permits which shall be for a term not to exceed two years. Renewal of permits shall be subject to review."

 

2.   By replacing the following definition in PART THREE - DEFINITIONS, Part 3.1:

 

"height" means the vertical distance from the average finished ground level at the perimeter of a building or structure, to the highest point of the building or structure. In the case of residential accessory buildings the measurement shall be taken to the mean distance between the eaves and the peak."

 

 

 

There were no letters received regarding these items.

 

 

Mr. Terry Evans of Ken Evans Ford addressed the Hearing and asked whether tent permits can be renewed after the initial 2-year period. He was advised that the permits can be renewed as long as the structure meets the building and fire code requirements, especially snow load and wind resistance. Mr. Evans noted that their clean-up department is located under tent structures and their intention is to provide permanent structures as budget permits.

 

 

Mayor Coleman called for further input three times and hearing none declared the hearing adjourned at 7:35 p.m.
